From Honor to Contempt: The Diplomatic Baseline and the Proof of Animus After Mullin v. Doe

<p><i>Mullin v. Doe</i> (2026) left constitutional claims as the only potential route for challenging the termination of temporary protected status, and it treated the availability of a race-neutral explanation for official statements as decisive against an equal protection claim. Weeks later, a federal district court applying <i>Mullin</i> to Somalia’s designation found a convincing showing of irreparable harm yet no likelihood of success. This Article proposes a doctrinal answer to that impasse, which it calls the diplomatic baseline. Where the government’s own archives preserve an internal, official, specific, and documented characterization of a national group, that record supplies the benchmark animus doctrine has long lacked, because a general policy position cannot explain a reversal confined to one nationality. The Federal Rules of Evidence pose no obstacle because the government’s own statements, offered against it, are statements of an opposing party under Rule 801(d)(2) rather than hearsay.</p> <p>Drawing on the Public Papers of the Presidents, internal memoranda published in the Foreign Relations of the United States series, the Federal Register, a report transmitted to the Security Council, and contemporaneous State Department and Defense Department records, the Article traces how the United States moved from receiving Somalia as a constitutional peer in 1962 and 1968, through six decades of instrumental engagement under administrations of both parties, to the categorical characterization of Somalis in 2025 and 2026. It then tests the stated rationale for the Somali termination against the government’s own contemporaneous conduct, answers the objections from uniformity, remoteness, changed conditions, selection, and <i>Trump v. Hawaii</i>, and marks the limits of the tool.</p> <p>The contribution is general and viewpoint neutral. Any litigant, of any national origin and against any administration, may hold the government to its own record.</p>
